CA Submits Contributions to Proposed Cybersecurity Law

The TMT (Technologies, Media and Telecommunications) team of CA– Cambule & Américo, Sociedade de Advogados, has just submitted its contributions to the Proposal for a Cybersecurity Law on the website platform of the National Institute of Information and Communication Technologies ( INTIC, IP).

In addition to suggestions for the textual construction of some provisions, the contributions are essentially around the following points:

  1. The Principles that guide the interpretation and application of the rules of the Law;
  2. The relationship and harmonization of the Bill with the Cybersecurity Policy and Strategy and the African Union Convention on Cybersecurity and Data Protection;
  3. The harmonization of the Proposed Law with other legal diplomas, with regard to the ICT regulated authorities;
  4. The obligations of some sectors of government vulnerable to cybercrime;
  5. The obligation to retain personal data; and
  6. Mechanisms for notifying security incidents to the competent authorities.

CA remains alert to the legal developments in this sector and hopes that the country will soon have a clear and consistent legal framework around it.
